In Yucatan, according to figures from the National Institute of Statistics and Geography (Inegi), almost five out of 10 workers do not receive the Christmas bonus due them.
Figures that emerge from the National Survey of Occupation and Employment (ENOE) in the third quarter of 2019, reveal that of 718,457 people classified as subordinate and paid staff, 478,508 are entitled to a holiday bonus this year.
But 234,365 will not receive the benefit, established by the Federal Labor Law, of at least 15 days of salary.
Attorney Lincoln Palma Rodríguez, a specialist in labor law, mentioned that workers are entitled by law to this benefit regardless of the time they have worked for the employer during the year.
Under Mexico Federal Labor Law Article 87, the bonus must be paid before Dec. 20 and be equivalent to at least 15 days of salary, Palma Rodríguez explained.
Workers who have not completed one year have the right to be paid a proportional share corresponding to the time they worked.
Workers whose labor relations are governed by collective contracts receive benefits superior to the legal minimum.
IMSS workers, for example, are paid 120 days of bonus, while federal and state government employees are given 40 days’ extra pay. Those who receive the biggest bonus are those working for the federal judiciary. They receive approximately a bonus equal to five months’ pay, said the labor lawyer.
